Amazon.com.ca ULC v. The Attorney General of Canada

The Federal Court of Appeal's order in file 24-A-38 granted leave to appeal an implementing decision under s. 31 of the Broadcasting Act, 1991. The appeal alleged that the implementing decision was ultra vires for failure to comply with the statutory conditions precedent to the exercise of the CRTC’s powers under ss. 9.1 and 11.1 of the Broadcasting Act and ultra vires s. 4 of the Order Issuing Directions to the CRTC (Sustainable and Equitable Broadcasting Regulatory Framework), S.O.R./2023-239. The appeal also alleged that the CRTC acted unlawfully by ordering certain foreign online undertakings to make “base contribution payments.” This case is ongoing.
